Booking Terms and Conditions

Horse Riding Holidays and Horse Riding in Greece

The following booking Terms and Conditions as wel as the Indemnity Agreement form your contract with Odysseia Stables.
You are requested to read them carefully.
Making your reservation with Odysseia you agree you understood all the below mentioned Booking Terms and Conditions, as wel as the Indemnity agreement.

Payment Policy

Guests pay 20% deposit to confirm their reservation.
Please first check availability with us.
After we hold the place(s) available for you, you are requested to fill in the booking from and pay the 20% deposit.
After receipt of the deposit by us, which can take up to 4 working days, you receive a confirmation of your reservation.

The remaining amount will be paid by bank transfer at least 3 weaks before your arrival date, or the remainig amount will be paid on arrival in the hotel.
Payment with credit card is possible, with the exception of American express. To do so we will sent you an e-mail with an authorization form which you can fill in and return to us by fax.

There is no refund for the 20% deposit.

Cancellation Policy

Reservation dates or riding program, depending on availability, can one time be changed for free until 6 weeks before the arrival date, within the same year.

Cancellation of the reservations longer than 56 days prior to the arrival date, the cancellation fee is the 20% deposit.
Cancellation of the reservations between 29 – 56 days prior to the arrival date, 50% of the total stay is charged.
Cancellation of the reservations between 1 – 28 days prior to the arrival date, 100% of the total stay is charged.
No show on the arrival day or cancellation of the holiday during your stay a 100% payment is charged.

Check in Policy

Check-In time: 14:00
Check-Out time: 12:00

Risk involved

You will be engaged in activities involving horses and other potentially dangerous recreational activities. You are informed and must understand that there are significant risks and dangers involved with horses and horseback riding and that horses are powerful and potentially
dangerous animals.
In reserving you holiday or horseback riding with Odysseia you have fully read and understood the Indemnity Agreement at the bottom of this page, and you fully agree with the Indemnity Agreement.

You are strongly advised for your own safety to wear a hard hat whilst in the vicinity of horses.
Odysseia provides riding hats for free in the stables.

Insurance

A holiday and health insurance is mandatory for all guests. You must check that your insurance covers you for the type of riding activity that you are going to participate in. Close a good travel insurance in your own country, due to repatriation issues.

General Conditions

The following conditions form your contract with Odysseia. You are requested to read them carefully.

1. Making your booking

To make your booking you must complete our booking form. The first named person (who must be at least 18 years of age) on behalf of all persons named on the booking form. The first named person confirms that he/she and all persons named on the booking form are fully aware of and accept the booking conditions. The first named person will be responsible for all payments due in respect of arrangements purchased.
First check availability and wait for our confirmation that we are holding places available for you. In this period you can reserve an apropriot flight. After that the booking form must be forwarded to us together with a deposit equal to 20% of the holiday price or any other amount as advised to you by Odysseia. If the booking is 4 weeks or less before departure the full payment must be made at the time of booking. Once we have received your booking form and all appropriate payments, we will confirm your holiday. Please check this invoice carefully as soon as you receive it and raise any queries you have immediately. No responsibility will be accepted by us if you do not inform us of any discrepancies within 10 working days of the issue of the confirmation invoice.

2. Your contract

Your contract with Odysseia comes into existence when we issue such a confirmation invoice. This contract and all matters arising from it are governed by Greek law and both parties submit to the exclusive jurisdiction of the Greek Courts.

3. Payment

The balance of the price must be received by us not less than 3 weeks before departure. After we have dispatched our confirmation invoice no further reminders will be sent. If payment is not received in full and on time we will be entitled to treat the booking as cancelled by you and apply the cancellation charges set out in paragraph 6 below.

4. The cost of your holiday

Odysseia reserves the right to increase or decrease the prices previously quoted for holiday arrangements before a booking is confirmed. You will be given the correct current price for your chosen arrangements at the time of booking.

5. If you change your booking

Should you wish to make any changes to your holiday after it has been confirmed, the person who signed the relevant booking form must advise us in writing. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests.

6. If you cancel your booking

A booking with us may be cancelled at any time before the departure date by the person who signed the relevant booking form by notifying us in writing. The date of cancellation will be the date written notice is received by us, so it is recommended to use recorded delivery. The following charges, expressed as a percentage of the total holiday price, will be payable to Odysseia by the person making the cancellation. Charges depend on the date cancellation is received.

Days before departure written notice is received with Cancellation charges:
Cancellation of the reservations longer than 56 days prior to the arrival date, the cancellation fee is the 20% deposit.
Cancellation of the reservations between 29 – 56 days prior to the arrival date, 50% of the total stay is charged.
Cancellation of the reservations between 1 – 28 days prior to the arrival date, 100% of the total stay is charged.
No show on the arrival day or cancellation of the holiday during your stay a 100% payment is charged.

7. Changes or cancellation by us

The information and particulars included in the  web site and in any information sheet or itinerary prepared by us has been carefully checked and great care is taken to ensure that such information and particulars are accurate at the time of publication. However itineraries are often planned far in advance and changes can occur. We reserve the right to make any changes to any published details (including, subject to paragraph 4, prices) and itinerary at any time. If you contact us about a proposed booking and changes have been made to the published information, we will endeavour to inform you of all such changes before your booking is confirmed. Once your booking has been confirmed we will try to ensure your trip is run as booked but in very rare circumstances it may be necessary to make changes after confirmation and we must reserve the right to do so. Any necessary changes will usually be minor but very occasionally it may be necessary to make a ‘significant change’. A significant change is a change in dates, a change to a lower standard of accommodation for the whole or a significant proportion of the trip, or a change to the whole or a significant proportion of your riding program. Where such a significant change is necessary we will notify you and give you three choices, to i) accept the change; or ii) cancel and (subject to paragraphs 8 and 9 which apply when change is necessary as a result of force majeure or low bookings) and receive a full refund other than amendment charges paid; or iii) if we are able to offer you one, book a substitute trip provided that if the substitute trip is more expensive than the original, you pay the difference in cost; if the substitute trip is less expensive the difference will be refunded to you. If you choose to cancel and receive a full refund under these circumstances you will also be entitled to compensation as set out in below. Our liability to you if significant changes are necessary is limited to offering you these choices and to compensation as set out below if appropriate. Where it is necessary to make minor changes to your arrangements (i.e. any change that is not a significant change as set out above) we will try to notify you but we are not obliged to give you, and you are not entitled to receive any refund or compensation as a result of minor changes.

If we are obliged to cancel your holiday for any reason other than i) a fault of yours (including non payment by you of any money due), ii) as a result of force majeure as defined in paragraph eight (paragraph 8 then applies) or iii) low bookings (paragraph 9 then applies), we will offer you a substitute holiday if one is available. If you book a substitute which is less expensive than the original we will refund you the difference in price. If the substitute is more expensive, you must pay the difference. If you do not wish to book a substitute or we cannot offer you one, we will give you a full refund.

8. Force Majeure

In the terms of a contract with us “force majeure” means unusual or unforeseeable circumstances beyond the control of Odysseia and the consequences of which neither Odysseia nor its suppliers, even with all due care, could foresee or . It includes but is not limited to riot, civil unrest, war, terrorist activity and the threat of any of the foregoing, industrial dispute, natural disaster, extreme adverse weather conditions, fire and similar events outside our control. It also includes any event or circumstance which the Foreign Office in Greece considers hazardous or threatening to tourists and as a result of which it is advising against non-essential travel to the country concerned.

On extremely rare occasions, circumstances or events which amount to force majeure may affect the area to which you plan to travel. As a result Odysseia and its suppliers may be unable to perform or complete the arrangements booked and may be obliged to change, cancel or curtail such arrangements at short notice. In these very unusual circumstances we will so our utmost to make suitable alternative arrangements for you but we will not be liable for a failure to do so, nor for any failure to provide the arrangements as originally booked. We will not compensate you for any losses or expenses that you may incur as a result of changes or cancellations due to force majeure. We will only refund you payments for arrangements that are cancelled or curtailed as a result of force majeure if and to the extent that we obtain refunds from our suppliers in respect of the same arrangements. Where we are able to make acceptable alternative arrangements for you, the cost of these shall be deducted from any such refunds we obtain and you will pay any additional costs. If circumstances which amount to force majeure exist before you commence your holiday but you are still able and wish to travel to your holiday destination and begin/continue with the arrangements as booked or altered in some way, we may require you to sign an acknowledgement accepting any risks involved before you start or continue with the arrangements.

9. Low bookings

Occasionally prices quoted for holiday arrangements assume a minimum number of participants. If this is the case we will notify you before your booking is confirmed. If the minimum number is not reached by the due date for the payment of your balance (4  weeks before the commencement of the holiday), we reserve the right to; a) cancel the departure or; b) postpone the due date for payment of the balance until four weeks before the start date or; c) with your agreement, continue with the arrangements for fewer participants at the necessary supplement payable by you. If we cancel as in option a) we will notify you in writing and will refund in full any deposit or other payment made to us by you for the arrangements (other than insurance premiums or amendment charges paid). If we postpone the payment date as in option b) we will notify you and then, before the new payment date, we will in writing either confirm the departure or notify you that the trip is cancelled. In the latter case we will also give you a full and prompt refund of any deposit or other payments made by you to us for the arrangements (other than amendment charges paid). Cancellations for low bookings will not be made less than 3  weeks before the start date.

10. Insurance

There are risks involved in adventure trips like those offered by Odysseia. Accidents can and occasionally do occur. Therefore it is a condition of your booking with Odysseia that you take out a suitable travel insurance covering you for all medical expenses, injury, death and liability as well as cancellation and curtailment, baggage and personal effects for the entire duration of your trip. You must make sure there are no exclusion clauses limiting protection for the type of activities included in your holiday. Although insurance is your sole responsibility we may require evidence of suitable cover before accepting your booking.

11. Liability

Whilst riding or in the vicinity of horses in the care of the operator or guide of your trip you must comply with the instructions of that person. It is a condition of your booking that you accept that the aforementioned guide or operator is entitled to require you to dismount or to refuse to allow you to ride if for any reason, including your inability, behaviour or health, they consider that you may endanger the safety or welfare of any person or the horses. If so required you have no claim and will not be entitled to any compensation or refund.

You acknowledge that there are risks involved in horse riding and confirm that you are fully aware of and accept these risks. You are strongly advised for your own safety to wear a hard hat whilst in the vicinity of horses. You understand that you may be required to sign a separate acknowledgement and acceptance of personal liability by the local supplier before being allowed to ride, and if you are not allowed to ride because you refuse to sign, you will have no claim against Odysseia or the supplier and will not be entitled to any refund or compensation.

In addition Odysseia’ liability is subject to the following limitations : liability other than for death or personal injury is limited to such amount as is reasonable taking into account the cost of the arrangements booked with us and the extent to which your enjoyment of them has been affected but (without prejudice to that) will not in any event exceed twice the cost of the arrangements booked for the person affected (excluding any amendment fees). In the case of loss and/or damage to and/or of luggage or personal possessions (including money) , our liability is limited to 25 Euro per person as you are assumed to have taken out adequate insurance at the time of booking.

Please note we cannot accept liability for any damage, loss, expense or other sum(s) of any description which i) on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have  you would suffer or incur if we breached our contract with you or; ii) did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses.

In all cases, the liability of Odysseia in relation to any service is limited in accordance with the provisions of all international conventions relating to the provision of such services as if Odysseia was a supplier of the services in question for the purpose of the relevant convention.

12. Travel documents

General information regarding passport requirements, visa and health formalities. Such matters are subject to change and you must check current requirements before departure. It is your responsibility to ensure that you have all the necessary documentation for your holiday and Odysseia will nor be held responsible for your not complying with requirements current at the time of your departure or any losses or costs incurred from such omission on your part. You are responsible for travel arrangements to and from the agreed meeting point.

13. If you have a problem

If you have a complaint or grievance whilst on holiday you must immediately inform the guide or operator of your trip so that he/she can try to put it right. If the matter cannot be resolved locally and you wish to make a complaint, you should telephone or fax Odysseia if practicable. In any case you must notify us in writing, giving full details of the complaint, such that it reaches us not later than 21 days after the last day of your holiday. If you fail to do either of these things we cannot accept responsibility for the matter giving rise to your grievance, having been unable to put it right immediately or investigate it at the appropriate time.

14. Special requests

Although we will endeavour to pass any reasonable requests, we regret we cannot promise that any request will be complied with unless we have specifically confirmed this in writing. Confirmation that a special request has been noted or passed on to us or the inclusion of the special request on your confirmation or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.

15. Behaviour

When you book a holiday with us, you accept responsibility for any damage or loss caused by you or any member of your party. Proper payment for any such damage or loss must be made at the time, directly to the accommodation owner or manager or other appropriate party. If you fail to do so, you must indemnify us against any claims (including legal costs) subsequently made against us as a result of your actions.

We expect all clients to have consideration for other people. If in our opinion or in the opinion of any other person in authority any person behaves in such a way as to cause or be likely to cause distress, danger or annoyance to any third party or damage to property, we reserve the right to terminate the holiday arrangements of that person without notice. In this situation, our responsibilities toward that person (including any return transport arrangements) will immediately cease and we will not be responsible for meeting any costs or expenses that they may incur as a result. We will not make any refunds or pay any compensation.

16. General. You agree that any photographs or film taken during a holiday or ride with us may be used by us in any publication or for promotional purposes.

Indemnity agreement

By reserving a holiday or horse riding trip with Odysseia, the participant agrees that he HAS READ AND FULLY UNDERSTANDS THIS indemnity agreement.

The participant is releasing and indemnifying Odysseia from various inherent risks,
known and unknown involving various recreational activities including, but not limited to, horses and horse-type activities and further releasing
Odysseia from provider’s negligence, if any, and, further releasingOdysseia from any results of the inherent risks and Odysseia’s
negligence, such results including, but not limited to, property damage, bodily and personal injury, illness, paralysis, or death.

Participant will be engaged in activities involving horses and other potentially dangerous recreational activities. Participant is informed and
understands: 1) That there are significant risks and dangers involved with horses and horseback riding and that horses are powerful and potentially dangerous animals; 2) That a horse may, at any time, without warning, and for no reason, jump up, forward, backward, or sideways; 3) That a horse may become uncontrollable, run wildly, buck, bite, kick, rear up, or step on feet or other body parts without warning; 4) Horses become tired, stressed, cantankerous, and their behavior is unpredictable; 5) A horse may trip, stumble, and/or fall down when being led, ridden, or otherwise attended to; 6) That weather, terrain, other animals, and/or people and other participant may adversely affect a horse’s behavior; 7) That these risks, and others, are inherent with horse and other activities which risks may not be anticipated, controlled, or eliminated by Odysseia and, further, Odysseia has no duty to do so; 8) That these risks and activities in general can cause property damage, bodily and personal injuries, illnesses, paralysis, and death to you or members of your family; 9) That Odysseia and/or other people and participant may, on occasion, be negligent (negligent meaning, generally, a failure to exercise ordinary or reasonable care) in their duties and responsibilities to participant and this negligence can cause property damage, bodily and personal injuries, illness, paralysis, and death to you or members of your family; 10) That the horseback riding activities and other activities will sometimes be in wilderness, and otherwise remote areas and that bodily and personal injuries, illnesses, paralysis, and other injuries may occur to you where you are a considerable distance from doctors, hospitals, and any type of medical help or assistance. Odysseia strongly recommends the use of a riding helmet which may minimize the risks of head and other injuries.

For and in consideration of the monies paid, agreements contained in this document, and your participation in Odysseia’s program, participant
does hereby completely release, acquit, and forever release and discharge Odysseia, their successors, personal representatives, and assigns of and from any and all actions, claims, demands, obligations, causes of action, damages, costs, loss of services, expenses, attorneys’ fees, and compensation of any kind or nature whatsoever on account of or in any way growing out of, or which in the future may result from, property damage, bodily and personal injuries, illnesses, paralysis, and death to you or members of your family as a result of participation in Odysseia’s program or in conjunction with recreational activities or Odysseia’s negligence. This agreement includes, but is not limited to, all claims or causes of action whether based on a tort, contract, or any other theory of recovery, which the participant now has or which may hereafter accrue or may otherwise be acquired on account of or may in any way grow out of any recreational activities including, but not limited to, any and all claims for emotional distress, loss of consortium, loss of companionship, loss of income, bodily or personal injury to participant, or members of participant’s family, or any wrongful death claim or punitive damage or any other claim of participant’s representatives or heirs which have resulted or may result from the recreational activities, acts, omissions, or negligence of Odysseia.
Participant further stipulates and agrees in further consideration, to fully indemnify and hold forever harmless Odysseia against loss from any and all claims, demands, or actions which may hereinafter or at any time be made or brought against Odysseia by any person or entity who has made, or agreed to make payments on Odysseia’s behalf for any medical expenses or any other obligations incurred by participant as a result of property damage, bodily and personal injury, illness, paralysis, and/or death to participant or any members of participant’s family arising out of Odysseia’s activities. Participant further agrees and stipulates to indemnify and hold forever harmless Odysseia against loss from any and all further claims, demands, or actions which may hereinafter or at any time be made or brought against Odysseia by any person or entity who claims to have been damaged, or who asserts a claim as a result of property damage, bodily and personal injury, illness, paralysis, and/or death to participant arising out of Odysseia’s activities.

Participant further stipulates and agrees to fully indemnify and hold forever harmless Odysseia from any action, claim, demand, obligation, cause of action, damages, costs, loss of services, expenses, and compensation of any kind or nature whatsoever on account of or in any way growing out of, or which in the future may result from property damage, bodily and personal injury, illness, paralysis, and/or death to any person, including minors and incompetents over whom and for whom participant has custody, control, and/or other legal responsibilities.
Participant acknowledges and agrees that participant’s participation in Odysseia’s recreational activities and riding program is completely
voluntary and participant acknowledges all risks, known and unknown, accepts all risks, known and unknown, and assumes full responsibility for all risks, known and unknown, including, but not necessarily limited to, those risks identified in this agreement and acknowledges and accepts full
responsibility for all property damage, bodily and personal injury, illness, paralysis, and death to participant and/or members ofparticipant’s
family. Further, participant represents: 1) Participant has completely and fully read this document, agrees to its terms, has been given ample
opportunity to seek legal counsel to review and advise participant as to the legal effect of this agreement and has been provided additional
opportunities to ask questions and make inquiries of Odysseia regarding this agreement; 2) Participant warrants and represents he/she has no
medical problems which might interfere with participant’s participation in Odysseia’s program; 3) Participant is voluntarily participating in the
recreational and horse activities with full knowledge of the activities and the risks involved; 4) Participant accepts and assumes the risks and legal
responsibilities for any and all injuries and damages which may result from those risks associated with participation in recreational or horseback riding activities; 5) Participant warrants and represents that he/she can fulfill any physical requirements involved with recreational and horse activities; 6) Participant understands that the presence of Odysseia’s personnel is no assurance of participant’s safety or lessens any risks assumed by participant; 7) Participant warrants and represents that he/she has obtained adequate medical/disability/life insurance or other monies to cover losses to himself or others.
Participant agrees to the conditions of booking as follows: 1) Participant must arrange travel to and from the starting point of the tour; 2)
Participant must carry valid travel documents appropriate to the destination; 3) the cost of the tour includes only those items described in the
itinerary and other costs incurred are extra; 4) If Odysseia cancels a ride at any time, Odysseia will refund only the amount the participant has paid
to Odysseia; 5) Odysseia is not responsible for problems participant may have due to travel delays or restrictions, medical problems, customs
regulations, natural disasters, acts of terrorism, acts of war, or actions of carriers; 6) Odysseia is not responsible for airline accidents or loss of luggage;
7) for participant’s protection, the ride leader reserves the rights to prevent anyone from riding whose riding ability is insufficient or whose behavior endangers the safety or welfare of other riders or horses. No refund will be made to people who are prevented from riding for any such reason nor to anyone who is unwilling or unable to complete a tour; 8) Participant agrees a facsimile or other electronically transmitted signature has the same force and effect as an original.

This release shall not be canceled, modified, or changed in any manner except by the written agreement of both Odysseia and participant. The
invalidity of any portion of this agreement shall not affect the validity of the remaining agreement.

If participant fails to comply with any of the terms of this agreement, participant shall be responsible for the payment of all attorneys´ fees, costs
and expenses incurred by Odysseia in responding to any such breach or in enforcing this agreement.

By reserving a holiday or horse riding trip with Odysseia, the participant agrees that he HAS READ AND FULLY UNDERSTANDS THIS indemnity agreement.
